These Terms & Conditions (“Terms”) govern your access to and use of this website (the “Site”) and any purchase of products from us.

2) Acceptance of these Terms

By browsing the Site, creating an account, or placing an order, you agree to these Terms and any policies we reference (including any Privacy Policy, Shipping Policy, Returns Policy, and Warranty information displayed on the Site).

If you do not agree, do not use the Site or purchase from us.

We may update these Terms at any time. The version in force at the time you place your order applies to that order.

3) Eligibility and customer responsibilities

You confirm that:

you are at least 18 years old (or have permission of a parent/guardian), and

all details you provide are accurate and up to date (shipping address, contact information, payment information).

You are responsible for maintaining the confidentiality of any account login details.

4) Products, descriptions, and accuracy

We aim to ensure product descriptions, specifications, images, and pricing are accurate. However:

product images are illustrative and may vary slightly due to lighting/screen settings, and

packaging/inclusions may change over time for improvements, provided the product remains materially as described.

If you require confirmation of a specific dimension, inclusion, compatibility, or use case, contact us before ordering.

5) Pricing, currency, and taxes

Prices are shown in AUD unless stated otherwise.

Prices may change at any time, but changes do not affect orders already placed and paid for.

Any taxes (including GST) are treated as displayed at checkout and/or on invoices.

6) Orders and contract formation

When you place an order, you are making an offer to purchase.

A binding contract is formed when we accept your order, which occurs when we confirm dispatch (or otherwise clearly confirm acceptance by email).

We may cancel or refuse an order where:

an item is out of stock,

there is a pricing/description error,

we suspect fraud or unauthorised activity,

the delivery address is not serviceable.

If we cancel an order, we will refund amounts paid for the cancelled items.

7) Payments

Payment is due at checkout unless the Site explicitly offers an alternative arrangement.

If a payment is reversed, disputed, or charged back, we may:

pause fulfilment,

request an alternative payment method, and/or

recover reasonable costs associated with dispute handling to the extent permitted by law.

8) Shipping and delivery
8.1 Dispatch and delivery estimates

Dispatch and delivery times shown on the Site are estimates only and may vary due to carrier delays, peak periods, or events outside our control.

8.2 Address accuracy

You are responsible for entering a correct and complete delivery address. If a parcel is returned due to an incorrect address, reshipping fees may apply.

8.3 Authority to Leave (ATL)

If you choose ATL (or the carrier applies ATL), the carrier may leave the parcel at your nominated address. Once delivered per carrier tracking, responsibility may pass to you (subject to any legal rights you may have).

8.4 Lost or damaged parcels

If your order arrives damaged or appears lost, contact us as soon as possible with your order number and supporting evidence (photos, packaging, tracking details). We will assist with an investigation and appropriate resolution.

9) Title and risk

Title (ownership) transfers when full payment is received (unless otherwise required by law).

Risk generally transfers upon delivery to your nominated address, subject to your non-excludable rights under Australian Consumer Law.

10) Returns, refunds, and Australian Consumer Law (ACL)
10.1 ACL rights (cannot be excluded)

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. If goods have a major failure, you may be entitled to a refund or replacement and compensation for reasonably foreseeable loss. If the failure is not major, you may be entitled to a repair or replacement.

Nothing in these Terms excludes or limits rights you have under the ACL.

10.2 Change-of-mind returns (store policy)

Unless otherwise stated on the Site, change-of-mind returns are offered only if:

the item is unused and in original condition,

all packaging/accessories/inclusions are intact, and

the return request is lodged within the timeframe stated on the Site (if none is stated, change-of-mind returns are not guaranteed).

Change-of-mind returns may be refused for:

clearance/final sale items,

items damaged after delivery due to misuse or incorrect installation/use,

items not in resalable condition.

Return shipping costs for change-of-mind returns are typically the customer’s responsibility unless we state otherwise.

10.3 Faulty or incorrect items

If an item is faulty, damaged in transit, or incorrect, contact us with:

order number,

description of the issue,

clear photos/videos and packaging photos.

We will assess and provide a remedy consistent with the ACL.

10.4 Refund method

If a refund is approved, it is generally processed back to the original payment method unless otherwise required or agreed.

11) Product-use and safety (water, glass, electrical)

If products involve glass, water, filtration, pumps, lights, or similar equipment:

place products on stable, level, weight-bearing surfaces,

follow any included instructions for setup and use,

keep electrical components away from splashes and use appropriate power protection where possible,

do not lift or move filled tanks/containers,

perform leak testing in a safe location before placing near valuable items or electronics.

You are responsible for safe installation, safe use, and ongoing maintenance. This does not limit ACL rights relating to defects or failures.

12) Warranties

Any manufacturer warranty or store warranty stated on the Site applies in addition to your ACL rights.

Unless we state a specific voluntary warranty period, only ACL consumer guarantees apply by default.

13) Promotions and discount codes

Discount codes are subject to any stated conditions and may be modified or withdrawn at any time.

Codes typically cannot be applied retroactively after an order is placed.

14) Intellectual property

All Site content (text, images, graphics, product presentation, branding) is owned by or licensed to us. You must not copy, reproduce, distribute, or exploit it without written permission.

15) User content (reviews/photos)

If you submit a review, image, or video, you grant us a royalty-free licence to use that content for marketing and Site content, unless you explicitly request otherwise in writing.

You represent that you have the rights to submit the content and it does not infringe third-party rights.

16) Prohibited use

You must not:

misuse the Site (hacking, interference, scraping, malicious activity),

submit misleading, unlawful, or defamatory content,

attempt fraudulent transactions.

We may suspend or block access for violations.

17) Third-party services

We may use third-party providers (payment processors, logistics carriers, analytics). Your dealings with them may be governed by their terms. We are not responsible for third-party outages or policies.

18) Limitation of liability

To the maximum extent permitted by law, we exclude liability for indirect or consequential loss. Where liability cannot be excluded, our liability is limited to the extent permitted by law, including providing remedies required under the ACL.

19) Force majeure

We are not liable for delays or failures caused by events beyond our reasonable control (carrier disruption, natural disasters, supplier shutdowns, government actions, etc.).

20) Governing law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of NSW courts.
